The application for regular bail was dismissed.
Summary
Jay Karan Kumar applied for regular bail for an offence under Sections 103(1), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, in PS Kahalgaon Case No. 116 of 2025. His earlier bail application was rejected on 8 October 2025. He filed a second bail application on 30 June 2026 but did not provide any information about the current stage of the trial. The High Court noted the lack of a statement on the trial status and, after hearing counsel, dismissed the bail application. The court directed the petitioner to approach the trial court for bail.
Issues considered
- What is the appropriate basis for granting or refusing regular bail in the second application?
- Does the petitioner’s failure to disclose the present stage of the trial affect the bail decision?
