The court granted anticipatory bail to the petitioner, subject to the conditions prescribed under Section 438(2) CrPC and Section 482 BNSS.

Summary

Vandana Kumari applied for anticipatory bail fearing arrest in a case (Saraiya P.S. Case No. 466 of 2024) alleging offences of cheating, forgery and criminal conspiracy under Sections 420, 467, 468, 471 and 120(B) of the IPC. The prosecution alleged she forged documents to obtain employment, while she claimed innocence and false implication. The court, noting that the petitioner is a woman, allowed the bail application. It ordered that if she is arrested or surrenders within four weeks, she be released on bail upon furnishing a Rs.10,000 bond with two sureties, subject to the conditions of Section 438(2) of the CrPC and Section 482 of the BNSS. The order was pronounced by Justice Sandeep Kumar.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in view of the alleged offences under the IPC.
