Patna High Court

Uttimlal Khatawe @ Uttimlal ChaupalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted as the seizure did not prima facie link the illicit liquor to the petitioner and he possessed a clean antecedent.

Summary

The petitioner, Uttimlal Khatawe, was named in an FIR for alleged illegal manufacturing and trading of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016, with 16.170 litres of liquor seized from a motorcycle. He contended that the seized liquor was not in his physical possession and that the seizure list lacked independent witnesses, asserting a clean antecedent. The Additional Public Prosecutor opposed bail. The court observed that the recovery did not prima facie establish the petitioner's possession and, considering his clean record, directed that he be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to conditions under Section 482(2) of the BNSS. The bail order was to be complied with within four weeks of the order. The decision reflects the court’s application of bail principles in excise offences where evidence of possession is doubtful.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016 given the facts of the case.
  • Whether the seizure of illicit liquor establishes the petitioner's physical possession for the purpose of denying bail.
  • Whether Section 482(2) of the BNSS is applicable for granting bail in this excise matter.
