DISMISSED

Holding

The Court dismissed the bail application, holding that there were no fresh grounds to review the earlier orders denying bail.

Summary

The petitioner, Rajesh Kumar, filed his fourth application for regular bail in a case registered under Sections 342, 366A, 376DA, 120, 34 of the Indian Penal Code and Section 4 of the POCSO Act. Earlier bail applications had been rejected on three separate occasions. The petitioner has been in custody since 13 October 2020, and all prosecution witnesses have already been examined, with the trial now awaiting the defence's arguments. The High Court examined whether there were any fresh grounds to revisit its earlier orders. Finding none, the Court concluded that the bail application could not be entertained. Consequently, the application for bail was dismissed.

Issues considered

  • Whether the petitioner is entitled to regular bail at this stage of the trial despite prior rejections and the fact that all prosecution witnesses have been examined.
