Saraswati Devi @ Saraswati DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner, subject to a bond and conditions under Section 482(2) of the Criminal Procedure Code.

Summary

Saraswati Devi, operator of a brick kiln, was named in a 2019 complaint alleging violations of Sections 37 and 38(D) of the Air (Prevention and Control of Pollution) Act, 1981. She had obtained provisional permission to operate the kiln on 29 May 2019, but the kiln became non‑operational due to the COVID‑19 pandemic. The petitioner applied for bail, arguing that the complaint was unfounded and that she had a clean antecedent. The State and the Bihar State Pollution Control Board could not refute the existence of the provisional order. The Court, noting the provisional permission, the lack of operational activity, and the petitioner’s clean record, directed that she be released on bail upon furnishing a bond of Rs 10,000 with two sureties, subject to conditions under Section 482(2) of the Criminal Procedure Code. The bail order was issued to ensure her release while the underlying complaint proceeds.

Issues considered

  • What is the appropriateness of granting bail to a petitioner charged under Sections 37 and 38(D) of the Air (Prevention and Control of Pollution) Act, 1981, given the existence of a provisional permission to operate the brick kiln and the petitioner’s clean antecedent?
