Ram Pravesh SinghversusThe State of Bihar

Decided

DISPOSED

Holding

The Court held that the petitioner’s alleged involvement was merely incidental to his official duties and therefore granted anticipatory bail.

Summary

The petition sought anticipatory bail for Ram Pravesh Singh, a district registrar, who was named in a complaint alleging execution of a false sale deed using forged ration and Aadhar cards, constituting offences under IPC sections 420, 465, 468 and 471. Singh contended that he acted only in his official capacity, had no personal knowledge of the parties, and was merely a witness to the registration. The prosecution opposed the bail, arguing the seriousness of the alleged offences. The Court observed that the allegations arose from Singh's official duties and that his connection to the alleged fraud was remote. Accordingly, the Court granted anticipatory bail, directing release on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner, acting in his official capacity as registrar, is entitled to anticipatory bail for alleged offences under IPC sections 420, 465, 468 and 471.
  • Whether the alleged remote connection of the petitioner to the fraud negates the necessity of his arrest.
