Patna High Court

Arun MukhiyaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted as the recovery of illicit liquor did not prima facie establish the petitioner's conscious possession.

Summary

The petitioner, Arun Mukhiya, was named in an FIR for alleged illegal manufacture and trade of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018, with 36 litres of liquor recovered from a cattle house that is jointly owned by his family. The petitioner contended that the liquor was not in his conscious physical possession because the cattle house is an open, accessible place. The Additional Public Prosecutor opposed the petition for anticipatory bail, citing the seriousness of the offence and the petitioner's involvement in three other criminal cases. The Court examined whether the recovery of liquor could be attributed to the petitioner’s conscious possession, a prerequisite for granting bail. Finding that the recovery did not prima facie demonstrate conscious possession, the Court directed that the petitioner be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC when the alleged offence involves alleged possession of illicit liquor.
  • Whether the recovery of liquor from a jointly owned, open cattle house establishes conscious physical possession of the petitioner under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
