BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs.10,000 and specified conditions.

Summary

Hari Govind Kumar was arrested on 11 April 2026 in connection with a case involving the alleged possession of 52 litres of illicit spirit, alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. The petitioner contended that the spirit was not in his conscious possession and that the seizure was conducted by police witnesses without complying with Sections 103 and 105 of the Bihar Non‑Statutory Substitution (BNSS) Act, 2023. He also asserted a clean antecedent and claimed false implication. The State opposed bail. The Court, after considering the facts and the alleged procedural lapses, granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, presence in court, non‑tampering with evidence, and verification of criminal antecedent. The bail order was made subject to cancellation if conditions were breached.

Issues considered

  • Whether bail should be granted to the accused in an offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the seizure of the illicit spirit complied with the procedural requirements of Sections 103 and 105 of the BNSS Act, 2023.
  • Whether the petitioner’s alleged clean antecedent and claim of false implication affect the grant of bail.
