Patna High Court

Rahul Kumar Yadav @ Rahul YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Bail was denied to the petitioner.

Summary

The petitioner Rahul Kumar Yadav was arrested in connection with a robbery and assault case (PS Raniganj Case No.362/2025) involving theft of Rs. 2,43,000 and possession of arms. The informant identified him as the person who snatched his bag and injured him; stolen items and a bike were recovered from him. Although his name was not in the FIR, it was linked through a co‑accused’s confessional statement. The petitioner applied for bail, arguing lack of direct FIR mention. The court examined the seriousness of the offences under Sections 309(6), 3(5) of the B.N.S. and Sections 25(1‑B)(a) and 26 of the Arms Act, and the material evidence, and concluded that bail could not be granted. Consequently, the bail application was dismissed, with the court noting its observations are prima facie and not to prejudice the trial.

Issues considered

  • Whether bail should be granted to the petitioner in view of the alleged robbery, assault and possession of arms
  • Whether the identification of the petitioner through a co‑accused’s confessional statement suffices for bail consideration
