The Court allowed the modification petition, granting an eight‑week extension for surrender subject to a deposit of Rs. 25,000 each.

Summary

The petitioners, Sahendra Yadav and his son Bosh Yadav, filed a petition seeking modification of the order dated 05-03-2021 in Criminal Appeal (SJ) No. 695/2020, which had set a deadline for their surrender. They requested an additional eight weeks to surrender and to furnish a bail bond, citing reasons detailed in the petition. The Court examined whether it could extend the surrender period and impose a condition of depositing Rs. 25,000 each with the District Legal Services Authority. Considering the petitioners' circumstances and the statutory discretion to modify procedural orders, the Court granted the requested extension. The order was modified to allow eight more weeks for surrender, subject to the stipulated deposit, and the modification petition was allowed.

Issues considered

  • Whether the High Court can modify the earlier order to extend the period for surrender in a criminal appeal
