Subrato MandalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

Subrato Mandal, a driver, was arrested on 3 April 2026 in connection with the seizure of 1,350 litres of illicit foreign liquor from a vehicle, alleged to be in violation of Sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Amendment Act, 2022. The petitioner claimed he had no ownership of the vehicle, was not in conscious possession of the liquor, and that he was falsely implicated. He sought bail, arguing a clean antecedent and lack of direct involvement. The Additional Public Prosecutor opposed the bail. The High Court, after considering the facts, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedent. The order directed that bail should not be delayed for verification purposes.

Issues considered

  • Whether the petitioner, a driver, is entitled to bail for alleged offences under the Bihar Prohibition and Excise Amendment Act, 2022.
  • Whether the seizure of liquor from the vehicle, without proof of the petitioner's conscious possession, justifies continued detention.
