Patna High Court

Satish kumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

Satish Kumar was arrested in connection with a case registered under multiple sections of the Bharatiya Nyaya Sanhita, 2023, including offences of assault and other serious crimes. He applied for regular bail, asserting his innocence, clean antecedents, and that he had been in custody since February 5, 2026. The State opposed the bail on the ground of the gravity of the charges. The Court examined the facts, noted the petitioner’s clean record, and considered that the bail application was not barred by the nature of the offences. Consequently, the Court allowed the regular bail, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of the same amount, and clarified that its observations were prima facie and not a determination on the merits of the case.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under multiple serious offences under the Bharatiya Nyaya Sanhita, 2023.
