Patna High Court

Kundan Kumar RayversusThe State of Bihar

Decided

Holding

The Court granted bail to the petitioners with specified conditions.

Summary

The petitioners, Kundan Kumar Ray and Mandip Kumar, drivers of a truck, were arrested in connection with the seizure of 785.5 litres of illicit foreign liquor and charged under Sections 111 and 3(5) of the BNS and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act. They contended that no liquor was found in their possession, they were unaware of the consignment, and the police had not complied with Section 105 of the BNSS while making the seizure. The State opposed bail, arguing the seriousness of the offence. The Court, after hearing both sides, found merit in the petitioners' claim of lack of knowledge and procedural lapse, and ordered that they be released on bail subject to conditions of cooperation, a near‑relative bailor, and a bond of Rs.10,000 with two sureties each. The bail order was directed to be satisfied before the Exclusive Special Excise Court No. 2, Siwan.

Issues considered

  • Whether bail should be granted to the drivers accused of transporting illicit liquor under the Bihar Prohibition and Excise (Amendment) Act and BNS provisions.
  • Whether the alleged non‑compliance of Section 105 of the BNSS by the police during seizure warrants bail.
  • Whether the drivers' claim of lack of knowledge and absence of personal possession of the contraband negates the presumption of guilt.
