The court ordered the release of the petitioner on regular bail.

Summary

Alok Kumar was arrested in connection with an alleged impersonation in a constable recruitment examination, charged under several IPC sections and the Bihar Conduct of Examination Act. The prosecution argued that another individual had taken the exam on his behalf, supported by biometric and photographic evidence that did not match the petitioner. The petitioner’s counsel contended that he was innocent, had no criminal antecedents, and that the actual impersonator, who was allegedly paid a sum of money, should be held liable. The petitioner had been in judicial custody since 21 February 2026. After hearing both sides, the Patna High Court granted regular bail, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences alleged.
  • Whether the biometric and photographic evidence presented by the prosecution is sufficient to deny bail.
  • Whether the alleged act of arranging an impersonator makes the petitioner culpable under the cited statutes.
