Lalsi DeviversusThe State of Bihar

Decided

PARTLY ALLOWED (DISPOSAL)

Holding

The Court allowed anticipatory bail for petitioners 1 and 3, subject to conditions, and dismissed the withdrawn application of petitioner 2.

Summary

The petitioners Lalsi Devi and Antima Devi, both women, were implicated in a criminal case (Nautan P.S. Case No. 481 of 2025) under Sections 103(1) and 3(5) of the Bihar Narcotic Substances Act, alleged to have murdered a deceased relative. They applied for anticipatory bail, while a third petitioner, Sonu Kumar, withdrew his application. The State opposed the bail on the ground of the seriousness of the offence. The Court, taking into account the petitioners' clean antecedents, their gender, and the submissions made, granted anticipatory bail to petitioners 1 and 3, subject to surrender within four weeks, a bail bond of Rs.10,000 with two sureties, and compliance with Section 438(2) of the CrPC and Section 482 of the BNSS. The application of petitioner 2 was dismissed as withdrawn.

Issues considered

  • Whether petitioners Lalsi Devi and Antima Devi are entitled to anticipatory bail under Section 438 of the CrPC in a case under Sections 103(1) and 3(5) of the BNSS.
  • Whether the withdrawal of petitioner Sonu Kumar's application affects the remaining applications.
