Patna High Court

Shoan Kumar @ Pravind KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to conditions under Section 438(2) CrPC and Section 482 BNSS.

Summary

The petitioner, Shoan Kumar, sought anticipatory bail in connection with a criminal case (PS No. 57 of 2026) where he was charged under several sections of the Bihar Negotiable Securities Act (BNSS) for alleged assault. The prosecution alleged that the petitioner assaulted the victim, while the petitioner claimed innocence and argued that the victim's injury was simple. The State opposed the bail, citing the seriousness of the charges. The court noted that the injury was indeed simple and, applying Section 438(2) of the Code of Criminal Procedure, 1973 and Section 482 of the BNSS, allowed the anticipatory bail. The petitioner was directed to surrender within four weeks and furnish a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC given the nature of the alleged offence and the simple injury to the victim
  • Whether the court can exercise its inherent powers under Section 482 BNSS to release the petitioner on bail
