Holding

The court granted anticipatory bail to petitioners 2, 3 and 4 subject to a bail bond of Rs.10,000 each and conditions under CrPC Section 438(2) and BNSS Section 482.

Summary

The petitioners, four residents of Jehanabad district, sought anticipatory bail in connection with a kidnapping and assault case (Kako P.S. Case No. 212 of 2024) where they were alleged to have abducted an informant's son and assaulted the informant with an axe. Petitioners 2, 3 and 4 claimed innocence, asserting they were falsely implicated over a land dispute and had clean antecedents, while the State opposed the bail. The court allowed the withdrawal of the application for petitioner 1, directing him to surrender and apply for regular bail. For petitioners 2, 3 and 4, the court granted anticipatory bail, imposing a bail bond of Rs.10,000 each with two sureties and subjecting them to conditions under CrPC Section 438(2) and BNSS Section 482. The order directs that they be released on bail if arrested or surrendered within four weeks.

Issues considered

  • Whether anticipatory bail should be granted to petitioners 2, 3 and 4 for offences under Sections 191(2), 190, 126(2), 115(2), 109(1), 352 and 351(2) of the BNSS.
  • Whether the nature of the alleged offences precludes the grant of anticipatory bail.
  • Whether the petitioners' clean antecedent and claim of false implication justify bail.
