Patna High Court

Vicky KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the anticipatory bail application, subject to the stipulated conditions.

Summary

The petitioner, Vicky Kumar, sought anticipatory bail in connection with a case (Bihta P.S. Case No. 883 of 2025) alleging possession of 25 litres of illicit foreign liquor under Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution had not apprehended the petitioner at the spot, and the petitioner claimed innocence, offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail. The High Court, after considering the facts and the petitioner's submission, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties, a donation of Rs.25,000 to Ramakrishna Mission, regular attendance at the police station, and verification that the petitioner is not an accused under the NDPS Act. The court emphasized that its observations were prima facie and limited to the bail application, not affecting the trial's merits. The order directed the lower court to enforce these conditions upon the petitioner's surrender or arrest within four weeks.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act where the petitioner was not apprehended at the scene.
  • Whether the conditions imposed, including a monetary donation and periodic police attendance, are permissible under law.
  • Whether verification of the petitioner's status under the NDPS Act is a valid condition for granting bail.
