Patna High Court

Manjit Kumar Yadav @ Manjit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is to be granted as the petitioner has a clean antecedent and the circumstances do not preclude bail under Section 482(2) of the BNSS.

Summary

The petitioner, Manjit Kumar Yadav, sought anticipatory bail in connection with Atri P.S. Case No. 296 of 2025, wherein he was charged under several sections of the Bharatiya Nyaya Sanhita, 2023 for alleged assault causing simple injury. The prosecution alleged that the petitioner had committed the offences, while the petitioner maintained his innocence and highlighted his clean criminal record. The State opposed the bail application, arguing the seriousness of the charges. The Court examined the facts, the petitioner’s lack of prior convictions, and the provisions of Section 482(2) of the BNSS governing anticipatory bail. Concluding that the petitioner’s antecedents were clean and the circumstances did not warrant denial of bail, the Court allowed the anticipatory bail with specified conditions. The order emphasized that the observations were prima facie and not a determination on the merits of the case.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023 despite the pending charges.
  • Whether the petitioner’s clean antecedent and the nature of the alleged offences justify the grant of anticipatory bail.
