Decided

BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioners subject to the conditions imposed under Section 482(2) of the Bharatiya Nyaya Sanhita.

Summary

The petitioners, six residents of Naya Tola, Harpur, sought anticipatory bail fearing arrest in a case (Piprakothi PS Case No. 46 of 2026) alleging offences under multiple sections of the Bharatiya Nyaya Sanhita, 2023 and the Prevention of Witch Practices Act. The FIR alleged that they, with common intention, assaulted an informant and her son. The petitioners contended they were innocent and highlighted that similarly situated co‑accused had been granted anticipatory bail in Cr. Misc. No. 27408 of 2026. The State opposed the bail. The Court, noting the precedent and the circumstances, allowed the anticipatory bail application, directing the petitioners to surrender within four weeks and furnish bail bonds with sureties, subject to conditions under Section 482(2) of the BNSS. The order was limited to bail considerations and not an assessment of the merits of the criminal allegations.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nyaya Sanhita in view of the alleged offences.
  • Whether the precedent of anticipatory bail granted to co‑accused in Cr. Misc. No. 27408 of 2026 is applicable to the present petition.
