The Court granted anticipatory bail to the petitioner, subject to specified conditions.
Summary
The petitioner, Sharwan Kumar Singh, filed an anticipatory bail application after an FIR under Section 30(a) of the Bihar Prohibition and Excise Act alleged his involvement in the seizure of 215.96 litres of foreign liquor from an e‑rickshaw. The petitioner argued that the liquor was not recovered from his conscious possession and that his name surfaced only through the co‑accused Gautam Prasad, contending that the seizure violated mandatory procedures under Section 100 of the CrPC and Section 103 of the BNSS, 2023. The State opposed bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and citing two similar pending cases against the petitioner. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019 (2) PLJR 1089), the Court held that the lack of direct possession and procedural lapses warranted relief. Consequently, the Court granted anticipatory bail on a bond of Rs 10,000 with two sureties, subject to conditions under Section 438(2) CrPC, Section 482(2) BNSS, 2023, and further directions to cooperate with the trial and disclose criminal antecedents.
Issues considered
- Whether anticipatory bail can be granted when the accused is not in conscious possession of the seized liquor.
- Whether the seizure complied with mandatory procedures under Section 100 CrPC and Section 103 BNSS, 2023.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail.
- Whether the petitioner’s other pending cases affect the grant of anticipatory bail.
