Patna High Court

Mandeep Kumar @ Mandeep Singh @ RishuversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The court refused bail to the petitioner.

Summary

Mandeep Kumar was arrested on 6 February 2026 in connection with a cyber‑crime case alleging that he operated a SIM‑box network and possessed numerous electronic devices and cash. The petitioner sought bail, claiming a clean antecedent and that the FIR was fabricated, with no material evidence beyond suspicion. The State opposed bail, highlighting the seizure of 18 items including multiple SIM‑boxes, SIM cards, routers, laptops, and cash, and alleging organized criminal conspiracy causing revenue loss to the government and telecom companies. The court examined the seriousness of the offences under the Telecommunication Act, 2023 and the Information Technology Act, 2000, and considered the potential danger to public safety and internal security. Concluding that the allegations were grave and the evidence indicated involvement in an organized cyber‑crime gang, the court refused the bail petition.

Issues considered

  • Whether the petitioner is entitled to bail despite the seriousness of the alleged cyber‑crime offences
  • Whether the material seized and the nature of the alleged organized conspiracy justify denial of bail
  • Whether the provisions of the Telecommunication Act, 2023 and the Information Technology Act, 2000 warrant custodial remand
