Patna High Court

Prabhu Kumar Gupta @ Prabhu SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, finding that his clean antecedent and the circumstances of the seizure justified release on bond.

Summary

The petitioner, Prabhu Kumar Gupta, a bus conductor, was arrested on 29 April 2026 in connection with a case involving the seizure of 189.640 litres of foreign/spirit liquor under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner argued that he had a clean antecedent and that the liquor was recovered from co‑accused persons and the bus, not directly from him, and that procedural requirements under Sections 103 and 105 of the BNSS, 2023, were not complied with. The State opposed bail, contending the seriousness of the offence. The Court considered the petitioner’s lack of prior convictions, the fact that the seizure was primarily from co‑accused, and the alleged procedural lapses, and consequently granted bail on a bond of Rs.10,000 with two sureties and several conditions. The bail order directed the petitioner to cooperate with the trial and warned of cancellation for non‑appearance, tampering with evidence, or concealment of antecedents. The bail was ordered to be effected without delay for verification of antecedents.

Issues considered

  • What is the appropriateness of granting bail to the accused conductor under Section 30(a) of the Bihar Prohibition and Excise Act?
  • Whether the non‑compliance with Sections 103 and 105 of the BNSS, 2023, warrants bail.
