The Court held that bail could not be granted to the petitioner.

Summary

The petitioner, Banti Yadav, applied for regular bail in a case registered under Buniyadganj Police Station for alleged offences of looting a bank, charged under Sections 310(2), 311 and 109 of the B.N.S. and Section 27 of the Arms Act. The prosecution alleged that the petitioner, along with others, participated in the robbery, and the petitioner has five prior criminal antecedents and has been in custody since 27‑01‑2025. Counsel for the petitioner argued that he was falsely implicated and pledged cooperation with the trial. The Additional Public Prosecutor opposed the bail, emphasizing the seriousness of the charges and the petitioner’s criminal record. The Court, after considering the allegations and the petitioner’s antecedents, declined to grant bail and dismissed the application.
