The court granted bail to the petitioner, subject to specified conditions, as the allegations were based on suspicion and no direct possession was established.
Summary
Petitioner Bhagwan Sah was arrested on 8 April 2026 in connection with a case involving the alleged possession of 20 litres of illicit spirit liquor, alleged to be a violation of Section 30(a) of the Bihar Prohibition & Excise Act, 2016. He contended that the liquor was recovered from a bamboo orchard and not from his personal possession, and that he has a clean criminal record, asserting that he was falsely implicated. The State opposed bail, but the court noted the absence of any material linking the petitioner directly to the seized liquor and his clean antecedents. Accordingly, the court granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation with the trial, appearance in court, and non‑tampering with evidence or witnesses. The bail order also directed verification of the petitioner’s antecedents and allowed cancellation of bail if false information is discovered.
Issues considered
- What is the appropriate decision on the petitioner's bail application given the alleged offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016 and the circumstances of the seizure?
- Does the lack of direct possession and the petitioner's clean antecedent justify granting bail despite the State's opposition?
