Patna High Court

Kumit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner, subject to specified conditions.

Summary

Kumit Kumar, a driver, was arrested on 16 April 2026 in connection with the seizure of 400.140 litres of Indian-made foreign liquor from a vehicle he was driving. He was charged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Amendment Act, 2018. The petitioner argued that he has a clean antecedent, is not the owner of the vehicle, and that the seizure list witnesses were police officers, indicating non‑compliance with Sections 103 and 105 of the BNSS, 2023. The State opposed bail. The High Court, noting the petitioner’s clean record and the procedural irregularities, granted bail on a bond of Rs 10,000 with two sureties, subject to conditions of cooperation, presence in court, and no tampering with evidence.

Issues considered

  • Whether bail should be granted to the driver charged under the Bihar Prohibition and Excise Amendment Act, 2018.
  • Whether the alleged non‑compliance with Sections 103 and 105 of the BNSS, 2023 affects the grant of bail.
  • Whether the petitioner’s status as driver, not owner, mitigates his liability.
