Patna High Court

Manju DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs 10,000 and specified conditions.

Summary

Manju Devi, a 70‑year‑old resident of Paduri, was arrested on 4 April 2026 in connection with FIR No. 1/2026 alleging offences under several sections of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The specific allegation of shooting the informant's father was directed at co‑accused Ranjit Mauar, and no direct act was attributed to the petitioner. The petitioner, represented by Mr. Ashok Kumar, pleaded for bail, emphasizing a clean antecedent and the absence of any specific charge against her. The State, through APP Ms. Renu Kumari, opposed the bail. The Court, considering the petitioner’s age, clean record, and lack of direct involvement, granted bail on a bond of Rs 10,000 with two sureties and imposed conditions regarding trial cooperation, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious charges under the BNS Act and Arms Act.
  • Whether the lack of a specific allegation against the petitioner and her clean antecedent justify bail.
  • Whether the actions of the co‑accused can be imputed to the petitioner for bail considerations.
