Patna High Court

Sonu Singh @ Priyanshu Shekhar @ PriyanshuversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner with a bond of Rs 10,000 and specified conditions.

Summary

The petitioner, Sonu Singh, was arrested on 3 February 2026 in connection with FIR No. 1157/2026 alleging that he and co‑accused fired upon the brother of an informant, causing injury. The FIR charges him under Sections 115(2), 126(2), 109, 352, 351(2)(3) r/w 3(5) of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The petitioner’s counsel argued that the FIR does not clearly identify who actually fired the shots and that the charge‑sheet is based merely on suspicion. The State opposed bail, noting that the petitioner has six other pending cases, though he is already on bail in those matters. The Court, after considering the lack of specificity in the FIR and the petitioner’s bail status in other cases, granted bail on a bond of Rs 10,000 with two sureties and imposed conditions regarding trial cooperation, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • What is the adequacy of the FIR in establishing the petitioner’s participation in the alleged firing?
  • Whether the seriousness of the offences and the petitioner’s other pending cases justify denial of bail?
  • Whether bail can be granted subject to conditions to ensure trial cooperation and prevent tampering.
