Patna High Court

Ranjeet Kumar Yadav @ Ranjit YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner, subject to a bond and specified conditions.

Summary

The petitioner, Ranjeet Kumar Yadav, was arrested on 17 April 2026 in connection with the seizure of 495 litres of Nepali liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act. He pleaded that he has a clean criminal record and that his name surfaced only through the statements of co‑accused persons, with no direct material linking him to the offence. The State opposed bail, but the court noted the lack of substantive evidence against the petitioner and his clean antecedent. Consequently, the court granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, presence in court, and non‑tampering with evidence. The bail order also directed verification of the petitioner’s antecedent without delaying the release.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act given the circumstances of the case.
  • Whether the disclosure by co‑accused persons suffices to establish a prima facie case against the petitioner.
  • Whether the petitioner’s clean criminal antecedent warrants the grant of bail.
