Patna High Court

Amar Kumar @ Amar Kumar YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court held that there was no ground to review its earlier order and therefore dismissed the bail application.

Summary

Amar Kumar Yadav applied for regular bail in a case (Jaynagar PS Case No. 171 of 2024) involving offences under Sections 394 and 307 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution alleged that unknown criminals looted a motorcycle and shot at an informant. The petitioner’s earlier bail application had been rejected on 23‑07‑2025. In the present hearing, counsel argued that the trial was progressing with three witnesses already examined, seeking bail. The High Court examined whether there was any ground to revisit its earlier order and found none, consequently dismissing the bail application again.

Issues considered

  • Whether regular bail can be granted to the petitioner for offences under IPC Sections 394, 307 and Arms Act Section 27.
  • Whether the earlier order denying bail can be reviewed in light of the trial’s progress.
