The Court granted anticipatory bail to the petitioner, subject to specified bond and conditions.
Summary
Ravi Yadav was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act after 129.9 litres of Nepali Kasturi liquor were seized from a school and a co-accused, Mojaffar Alam, named him. The petitioner argued that the FIR and seizure list showed no direct involvement by him and that the only evidence was the co-accused’s disclosure, with no compliance of mandatory recovery procedures under Section 100 CrPC/Section 103 of the BNSS, 2023. The State opposed anticipatory bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and citing two other similar cases where the petitioner was already on bail. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019) and noting the lack of material evidence, the Court granted anticipatory bail subject to a bond of Rs.10,000, two sureties, and conditions under Section 438(2) CrPC and Section 482(2) BNSS, 2023. The order also imposed compliance conditions such as cooperation in trial and non‑tampering with evidence.
Issues considered
- Whether anticipatory bail can be granted when the petitioner is implicated solely on the basis of a co‑accused’s statement.
- Whether the procedural requirements under Section 100 CrPC/Section 103 BNSS, 2023 for seizure were complied, affecting bail eligibility.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail in such cases.

more cases other than the present one of similar nature but fairly
submits that the petitioner is on bail in both the cases, as
mentioned in para-3 of the anticipatory bail petition.
