The court granted anticipatory bail to the petitioner, subject to specified conditions and the payment of Rs.20,000 to the District Legal Services Authority.
Summary
The petitioner, Anand Mehra, sought anticipatory bail fearing arrest in a case (Purnea Sadar PS Case No. 507 of 2025) under Section 109 of the Bihar Narcotic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Act after police, acting on secret information, seized 741 litres of foreign liquor from a "magic van" and his name appeared in the FIR. He contended that he neither owned nor drove the vehicle, had no criminal antecedent, and was implicated solely on suspicion, offering to contribute Rs.20,000 to the District Legal Services Authority for a public‑interest activity. Relying on the Patna High Court’s decision in Ram Vinay Yadav v. State of Bihar, which allowed anticipatory bail despite the bar under Section 76(2) when no offence is made out, the court examined whether the petitioner’s circumstances justified bail. The court granted anticipatory bail with several conditions, including the Rs.20,000 contribution, a bail bond of Rs.10,000 with two sureties, regular appearances before police and court, and prohibitions against tampering with evidence or committing further offences. The order would become null if the petitioner is later found to have a criminal antecedent.
Issues considered
- Whether anticipatory bail can be granted in a case under the Bihar Prohibition and Excise Act despite the bar under Section 76(2) of the Act.
- Whether mere mention of the petitioner’s name in the FIR, without possession of the seized liquor or ownership of the vehicle, suffices to deny anticipatory bail.
- Whether imposing a condition of payment to the District Legal Services Authority is a valid condition for granting anticipatory bail.

ORAL ORDER
2 01-07-2026 Heard the parties.
2. The petitioner is apprehending his arrest in
connection with Purnea Sadar P.S. Case No. 507 of 2025 for the
offence under section 109 of the BNS and section 30(a) of the
Bihar Prohibition and Excise Act.
3. As per the prosecution story, the Police, on secret
information, intercepted a magic van and from it,
recovered/seized 741 liters of foreign liquor and the name of the
petitioner cropped up. This led to the FIR.
4. Learned counsel for the petitioner submits that
neither he has criminal antecedent nor he owns the vehicle or
was driving it and only on suspicion, he has been implicated. The
last submission is that without accepting the allegation and/or the

outcome of the present case, the petitioner intends to contribute
Rs. 20,000/- to the District Legal Services Authority, Purnea for
putting up flower pots in the Civil Court Campus of Purnea

the State Bank of India.
5. Further, learned counsel for the petitioner relied on
the judgment of the Full Bench of Hon’ble Patna High Court in
the case of Ram Vinay Yadav vs. State of Bihar reported in
2019 (2) PLJR 1089 wherein it has been held that an application
for anticipatory bail in a case arising out of Bihar Excise and
Prohibition Act can be maintained, despite the bar under Section
76(2) of the Act, if on the basis of allegation made in the FIR, no
offence under the said provision is made out.
6. Learned APP opposes the prayer submitting that his
name has cropped up before the Police.
7. Taking into account the submissions of the parties
and the judgment in the case of Ram Vinay Yadav (supra), as
also that nothing has been recovered from his conscious
possession nor he owns the vehicle and/or has criminal
antecedent, in that background, this Court is inclined to extend
him the privilege of anticipatory bail with conditions subject to
payment of Rs. 20,000/- to the District Legal Services Authority,
