Anticipatory bail was granted with specified conditions.
Summary
The petitioner, Ramesh Marandi, sought anticipatory bail fearing arrest in a case (Belhar P.S. Case No. 201 of 2025) for alleged possession of 60 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence and offered to donate Rs.10,000 to a charitable organization without admitting guilt. The court considered the application under Section 438(2) of the CrPC and Section 482 of the BNSS. Finding no substantive reason to deny bail, the court granted anticipatory bail subject to a cash deposit, bail bond, sureties, and regular attendance at the police station. The order also required verification of the charitable donation receipt before bail bonds could be accepted.
Issues considered
- Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act
