JAVED ALIversusThe State of Bihar

Decided

BAIL REJECTED

Holding

Anticipatory bail was refused as the petitioner’s ownership of the seized truck established sufficient suspicion of involvement.

Summary

The petitioner, Javed Ali, the registered owner of a truck from which 573.84 liters of illicit liquor were seized, sought anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution alleged that the liquor was recovered from his vehicle, but the petitioner argued that no incriminating material was found in his personal possession and that he was implicated only on suspicion, asserting a clean antecedent. The State opposed the bail, emphasizing the petitioner’s ownership of the seized vehicle. The court examined the link between ownership of the vehicle and the alleged offence, finding that ownership alone sufficed to raise a reasonable suspicion of involvement. Consequently, the court refused the petition for anticipatory bail. The bail application was dismissed.

Issues considered

                                2. Petitioner apprehends arrest in Paru P. S. Case No.

111 of 2026 registered for the offence punishable under Section

30(a) of Bihar Prohibition and Excise Act.

                                3. As per prosecution case, 573.840 liters illicit liquor

                                4. Learned counsel for the petitioner submits that no

incriminating material has been recovered from conscious

possession of the petitioner. Petitioner has got no concern with

the alleged recovery and he has been made accused in this case

only on suspicion. Petitioner claims clean antecedent.

                                5. Learned A.P.P. for the State opposes the prayer for

                                     6. Considering the fact that petitioner is owner of the
