BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a cash bond, sureties and compliance with conditions under Section 480(3) of the B.N.S.S.

Summary

The petitioner, Vickey Sah, applied for bail in a case registered under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act for allegedly storing and transporting large quantities of illicit liquor. The prosecution alleged that a raid recovered 213 litres of Nepali liquor and a motorcycle from a house unrelated to the petitioner. The petitioner claimed innocence, stating no incriminating material was found in his possession and that he was falsely implicated; he had been in custody since 29‑01‑2026 and a charge‑sheet had been filed. The learned APP opposed bail. Considering the facts, the period of custody, and the filing of the charge‑sheet, the court ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 480(3) of the B.N.S.S. and additional personal surety requirements.

Issues considered

  • Whether bail should be granted to the petitioner under the Bihar Prohibition and Excise Act despite the recovery of liquor from a location not linked to him
  • Whether the petitioner’s custody period and filing of charge‑sheet justify bail
