Patna High Court

Vikash ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court ordered the release of the petitioner on regular bail subject to bond and surety conditions.

Summary

Vikash Manjhi was arrested in connection with a murder case (Sections 302, 201 and 34 IPC) alleging he killed his wife and concealed the body. The petitioner contended that the wife had committed suicide after a marital quarrel and that he was falsely implicated; the victim's father had filed a compromise petition stating no involvement of the husband. The State opposed bail, citing the seriousness of the offences. The court examined the compromise petition, the petitioner's clean antecedents, and the ten‑year gap since the alleged incident. It granted regular bail on a bond of Rs.10,000 with two sureties, subject to the petitioner’s cooperation with the trial.

Issues considered

  • Whether regular bail can be granted in a case involving murder, culpable homicide and abetment under Sections 302, 201 and 34 IPC.
  • Whether the compromise petition and the petitioner's clean antecedents justify bail despite the seriousness of the charges.
