Holding
The Court held that bail should be granted to the petitioner subject to a bond and conditions.
Summary
The petitioner, Amit Kumar Giri, was named in FIR No. 509 of 2025 for alleged assault and related offences under multiple sections of the Bharatiya Nyaya Sanhita, 2023. He sought bail, contending that the incident occurred on 04‑12‑2025 during a village baraat, the injury to the informant was minor, and there was an unexplained eight‑day delay between the occurrence and filing of the FIR. The State opposed bail, acknowledging the delay but emphasizing the seriousness of the allegations. The Court noted the delay, the simple nature of the injury, and the petitioner’s clean antecedents, and consequently ordered his release on bail subject to a bond of Rs.30,000 and conditions under Section 2(1)(d) and Section 482(2) of the B.N.S.S. 2023. The bail order was conditioned on surrender before the trial court within four weeks.
