Patna High Court

Saroj RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, subject to specified conditions.

Summary

Saroj Rai was arrested on 17 May 2026 in connection with a 2021 case involving the alleged illegal possession of 211.5 litres of foreign liquor, alleged under Sections 30, 30(a) and 41(1) of the Bihar Prohibition & Excise Act. The petitioner argued that the liquor was seized from his vehicle and not from his conscious possession, that he has a clean criminal record, and that the investigating authorities failed to comply with Sections 103 and 105 of the BNSS, 2023. The State opposed bail. The Court, noting the lack of direct possession, the petitioner’s clean antecedent and the procedural lapses, ordered his release on bail of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, and non‑tampering with evidence. The bail bond was to be accepted without delay for verification of antecedents. The order also empowered the prosecution to move for cancellation if conditions are breached.

Issues considered

  • Whether bail should be granted to the accused under the Bihar Prohibition & Excise Act offences.
  • Whether the non‑compliance of Sections 103 and 105 of the BNSS, 2023 justifies granting bail.
  • Whether ownership of a vehicle from which liquor was seized is sufficient grounds for continued detention.
