Bail was granted to the petitioner subject to a bond and specified conditions.
Summary
Nilam Devi was arrested on 4 May 2026 in connection with an excise case involving the seizure of 32.4 litres of foreign liquor, of which 10.8 litres were allegedly found in her possession. She sought bail, claiming a clean antecedent and that she had been falsely implicated. Her counsel argued that the seizure list was prepared by police officers, violating Sections 103 and 105 of the Bihar Narcotic Substances Act, 2023, and that procedural non‑compliance warranted bail. The State opposed the bail application. The Court, noting the alleged procedural lapses and the petitioner’s clean record, granted bail on a bond of Rs. 10,000 with two sureties and imposed conditions regarding trial cooperation, non‑tampering with evidence, and verification of antecedents.
Issues considered
- Whether the alleged non‑compliance with Sections 103 and 105 of the Bihar Narcotic Substances Act, 2023 justifies granting bail.
- Whether the petitioner’s clean criminal antecedent and claim of false implication merit bail despite the alleged offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
- Whether the seizure list prepared by police officers violates statutory requirements, affecting the bail decision.
