Patna High Court

Purushottam KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to monetary bond and specified conditions.

Summary

Petitioner Purushottam Kumar was arrested on 6 April 2026 in connection with a case under Section 30(a) of the Bihar Prohibition & Excise Act, 2016, for the alleged possession of 176.4 litres of foreign liquor seized from a car he owned. He contended that the liquor was not in his conscious possession and that he was falsely implicated merely as the car owner. The State opposed bail, citing the mobile tower location of the petitioner at the scene and a similar pending case against him, though it acknowledged his bail in that other matter. The Court, after considering that nothing was recovered from the petitioner’s direct possession, granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents. The bail order was directed to be implemented without delay for verification purposes.

Issues considered

  • Whether bail should be granted when the accused is not in conscious possession of the seized liquor.
  • Whether the mobile tower location evidence justifies denial of bail.
  • Whether a pending similar case against the accused affects the grant of bail.
