Patna High Court

Akshay RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding insufficient evidence of involvement and noting procedural non‑compliance.

Summary

The petitioner, Akshay Ram, was arrested on 3 May 2026 in connection with an excise case involving the seizure of 486 litres of country-made liquor, alleged to be offences under Sections 30(a) and 47 of the Bihar Prohibition & Excise Act. He claimed to have a clean antecedent and argued that he was falsely implicated, asserting that the seized liquor was recovered from a vehicle he neither owned nor drove. The petitioner contended that the investigation yielded no material linking him to the offence and highlighted non‑compliance with the mandatory provisions of BNSS, 2023. The State opposed bail, but the court noted the lack of substantive evidence and the procedural lapse, and consequently ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions of cooperation, presence in court, and verification of antecedents. The bail order also empowered the prosecution to seek cancellation if evidence tampering or concealment of criminal history occurs.

Issues considered

  • What is the applicability of Sections 30(a) and 47 of the Bihar Prohibition & Excise Act to the petitioner?
  • Does the non‑compliance of the mandatory provisions of BNSS, 2023 justify granting bail?
  • Is there sufficient evidentiary basis to justify continued detention of the petitioner?
