The Court granted anticipatory bail to the petitioner, subject to specified monetary and procedural conditions.
Summary
The petitioner, Baiju Kumar, sought anticipatory bail fearing arrest in a case (PS Ram Krishna Nagar Case No. 881 of 2024) under Section 30(a) of the Bihar Prohibition and Excise Amendment Act after 5 litres of illicit liquor were recovered from his scooty. He claimed innocence, asserted he was not an accused in any other excise matter, and offered to donate Rs.10,000 to a charitable organization without admitting guilt. The High Court, after hearing counsel, allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties, deposit an identical amount with Ramakrishna Mission, and produce the receipt. The Court also ordered verification of any other pending excise cases against him and mandated his attendance at the police station on the first and third Sundays of each month, with default leading to cancellation. The order was limited to the bail application and did not express any opinion on the merits of the underlying criminal case.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438(2) of the CrPC and Section 482 of the BNSS in the context of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.
- Whether the conditions imposed by the Court, including monetary deposit, verification of antecedent cases, and periodic police station attendance, are lawful and appropriate.
