Patna High Court

Jadu RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner with specified conditions.

Summary

Jadu Ram was arrested in connection with the alleged possession of 40 litres of country‑made liquor recovered from his scooter, alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. The petitioner claimed he was falsely implicated, had a clean antecedent, and had been in custody since 19 April 2026. The State opposed his bail application. The Court examined the facts, noting the lack of prior record and the petitioner's claim of innocence, and considered the nature of the offence. It ordered his release on regular bail upon furnishing a Rs.10,000 bond with two sureties, one of whom must be a family member, and imposed conditions of cooperation and appearance in court. The bail may be cancelled if the petitioner tampers with evidence or witnesses.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the petitioner’s claim of false implication and clean antecedent justify regular bail.
