Decided
Disposal
DISMISSED

Holding

Anticipatory bail was denied to the petitioners.

Summary

The petitioners, Suraj Das and Sunil Das, applied for anticipatory bail fearing arrest in a case registered under Sections 115(2), 126(2), 109(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, alleging assault causing serious injury. The prosecution alleged that the petitioners assaulted the victim, while the petitioners claimed they were falsely implicated and are agnates of the informant. The State opposed the bail, emphasizing the seriousness of the offences. The Court, after hearing both sides, declined to grant anticipatory bail, citing the nature and gravity of the alleged offences. The petitioners were directed to surrender within four weeks to seek regular bail, and the Court clarified that its observations were limited to this application and would not prejudice later stages of the case.

                                   6. Considering the nature and gravity of offence, this

                                   7. Accordingly, this application for anticipatory bail is
