BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioners under Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.

Summary

The petitioners, Nitu Kumari and Malti Devi, feared arrest in a criminal case (Arwal P.S. Case No. 279 of 2025) involving offences under several sections of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that a person named Nitish Kumar misbehaved with the informant’s daughter, and the petitioners, being his family members, were implicated. The petitioners contended they were innocent and sought anticipatory bail, while the State opposed the relief. The Court, noting the petitioners are women and considering the circumstances, granted anticipatory bail subject to a bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the BNSS. The order was made clear to be prima facie and not affect the merits of the trial.

Issues considered

  • Whether anticipatory bail can be granted to the petitioners under the Bharatiya Nyaya Sanhita, 2023
  • Whether Section 482(2) of the BNSS authorises the grant of anticipatory bail in the present facts
