Kaushal Ranjan @ Kamal SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The application for regular bail is allowed.

Summary

The petitioner, Kaushal Ranjan, was arrested in connection with a case registered under Sections 376, 506, 500 of the Indian Penal Code and Section 67 of the Information Technology Act for allegedly taking and publishing intimate photographs of a woman, pressuring her for marriage, threatening her, and causing mental distress. The petitioner contended that the relationship was consensual between two adults, he was falsely implicated, and he has a clean antecedent, having been in custody since 16‑11‑2025. The State opposed his bail, arguing the seriousness of the offences. The Court examined the facts, the nature of the allegations, and the petitioner’s cooperation, and decided that bail could be granted. Accordingly, the Court ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether bail should be granted in a case involving offences of rape, criminal intimidation, defamation and publishing obscene material under the IT Act.
  • Whether the alleged conduct constitutes a non‑bailable offence warranting continued detention.
  • Whether the petitioner is likely to flee or tamper with evidence.

notice has been served upon O.P. No. 2.

                                3. The petitioner seeks bail in connection with

present case. Learned counsel further submits that from the

for regular bail of the petitioner.

                                     7. Considering the facts and circumstances of the

case, this application for regular bail is allowed.
