Holding
The Court granted regular bail to the petitioner, directing his release upon furnishing a bond with conditions.
Summary
Ashish Kumar was arrested in connection with an alleged robbery and assault case registered under Section 309(4) of the Bhartiya Nyaya Sanhita. The petitioner contended that he was falsely implicated due to village politics, was not named in the FIR, and that no Test Identification Parade had been conducted. He further argued that the search and seizure provisions of Sections 103 and 105 of the Bhartiya Nagrik Suraksha Sanhita were not complied with, and no stolen property was recovered from him. The State opposed his bail application, citing the seriousness of the alleged offence. The High Court, after considering the procedural lapses and lack of incriminating material, ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions of family surety, cooperation with the trial, and appearance in court.
