The bail application is disposed of, with liberty granted to the petitioner to approach the magistrate for bail, subject to an undertaking regarding his wife's residence.
Summary
The petitioner, Prakash Noniya, sought relief from imminent arrest in a dowry‑related complaint (Case No. 422C of 2024) alleging offences under the Bharatiya Nyaya Sanhita, 2023 and the Domestic Violence (Prevention) Act. The prosecution alleged that he tortured and assaulted his wife for dowry demands. The petitioner denied any wrongdoing and pledged to keep his wife with dignity. The State opposed bail. The High Court, after hearing both sides, dismissed the bail application but directed the petitioner to file a fresh bail application before the concerned magistrate, attaching an undertaking regarding his wife's residence. The court left the final bail decision to the magistrate based on the parties' statements.
Issues considered
- Whether the petitioner is entitled to bail pending trial for offences under the Bharatiya Nyaya Sanhita and the DP Act
- Whether the petitioner’s undertaking to keep his wife with dignity influences the bail decision
