Patna High Court

Bhograj Rai @ Bhograj YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to specified conditions.

Summary

The petitioner, Bhograj Rai, sought anticipatory bail fearing arrest in a case (Kalyanpur PS Case No. 114 of 2026) involving the alleged seizure of 120 litres of illicit country-made liquor under Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution alleged his involvement, while the petitioner claimed innocence despite having four prior criminal antecedents. The State opposed the bail, arguing the seriousness of the offence. The Court examined the applicability of Section 438(2) of the CrPC and Section 482 of the BNSS for granting anticipatory bail. Finding no compelling reason to deny bail, the Court allowed the application, imposing a bail bond of Rs.10,000 with two sureties, a deposit of Rs.25,000 to a charitable institution, and regular police attendance. The order is subject to cancellation if the petitioner defaults on the conditions.
