Anuj Rajbanshi @ Anuji Rajbanshi @ Anuj RajvanshiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to the stipulated conditions.

Summary

The petitioner, Anuj Rajbanshi, sought anticipatory bail fearing arrest in a case (PS Neemchak Bathani Case No. 207 of 2025) involving alleged possession of 45 litres of illicit country-made liquor under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act. He asserted his innocence and a clean antecedent, while the State opposed the bail. The High Court, applying Section 438(2) of the Code of Criminal Procedure and Section 482 of the Bihar Narcotic and Smuggling Act, allowed the anticipatory bail with a bond of Rs.10,000, two sureties, a mandatory deposit of Rs.25,000 to a charitable institution, verification of his clean antecedent, and a condition to appear at the police station on specified Sundays. The order also stipulated that any default would lead to cancellation of bail. Consequently, the petitioner was released on bail subject to these conditions.

Issues considered

  • Whether anticipatory bail can be granted in offences under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed (bond, sureties, monetary deposit, verification of antecedent, periodic police‑station attendance) are permissible under Section 438 CrPC and Section 482 BNSS.
